Suggestions for the Lee Jae-myung Administration’s Cybersecurity Law and Strategy

While overseas intelligence gathering involves going beyond national borders to respond to cyber threats that threaten national security , overseas intervention response primarily addresses cyber threats that enter our cyberspace . The failure of attempts to enact basic laws related to cybersecurity over the past 20 years has largely been due to power struggles between government ministries over cybersecurity governance , rather than considering national cybersecurity from the public’s perspective . It is necessary to end further wasteful legislative debate and instead strengthen national cybersecurity through individual laws . The current Presidential Decree, the Cybersecurity Business Regulations, allows for proactive, proactive tracking and neutralization of bases located overseas or in North Korea , targeting activities by North Korea , foreign countries , foreign nationals , foreign organizations , transnational actors , or domestic individual sassociatedwith them that are contrary to national security and interests . This is undesirable from a legal perspective . These measures, which have the potential to infringe on human rights and sovereignty, should be regulated by law, as in the so-called ” Active Cyber Defense Act ” recently passed by the Japanese Diet in May , as well as in similarly positioned countries such as the United States , the United Kingdom , and Australia . Furthermore , mechanisms must be established to control the misuse of preemptive tracking and neutralization measures . Accordingly , the National Intelligence Service Act, the primary legal framework, must be revised . Furthermore , to respond to foreign intervention activities through online information manipulation, Japan must enact new laws, as other similarly positioned countries have , and revise related laws, including espionage laws.

The National Cybersecurity Strategy is what provides the overall blueprint for national cybersecurity . As mentioned in the study of national cybersecurity strategies of seven countries ( the United States , the United Kingdom , Germany , Australia , Japan , Singapore , and South Korea ) conducted by the Belfer Center at Harvard University ‘s Kennedy School in 2024 , in which South Korea ranked last , South Korea’s national cybersecurity strategy has lacked specificity and failed to contain a comprehensive national strategy . The Lee Jae-myung administration’s national cybersecurity strategy should be a more comprehensive and specific strategy that builds on the contents of the Cyber Basic Planning Group , and should reflect changes in the new security environment based on a review of the implementation of previous strategies .
